The PP will lead to debate at the Plenary session of the Congress next week his bill to reform the Civil Code, the Mortgage Law and the Civil procedure Act with the aim of eliminating the ‘objectification’ of legal animals, and that they, as living beings, are considered to be subjects of the law.
It has been pointed out by the spokesman of the ‘popular’ in the Lower House, Rafael Hernando, who has explained that the objective is that the pets are no longer considered things in the Spanish legislation and to give them “a different range,” which will provide “more protection”. Hernando has been noted that domestic animals should have rights, although it has reminded that this situation “also implies obligations to holders of animals”.
The text of the PP seeks to amend several articles of the Civil Code relating to the regulatory agreement in the divorce, separation or annulment of the marriage, with the goal of adding new points that govern the fate of pets in that, according to the text that they propose, should be based on the interest of the members of the family and the welfare of the animal, “being able to anticipate the distribution of the times of enjoyment if necessary”.
The ‘popular’ also are intended to prevent companion animals to be seized to their owners to non-payment of rent, that pets do not enter into the covenant of the extension of the mortgage proposed to be included as real estate incubators, dovecotes, kennels or hives, among other habitats, animals, always, and when the owner has placed them or preserved with the goal of keeping them united to the estate and forming a part of it on a permanent basis.
Citizens opened the debate
The PP has denounced that, in the current society, animals are appropriable, and the object of trade between men. “The relationship of the person and the animal, whether of domestic, wild, or savage, is a relation of private property, although it has to be modulated by the quality of being endowed with sensitivity about who is responsible for that property”, says the document, picked up by Europa Press.
“Well, the powers of use and enjoyment of the animal, such as the provision on the same, have to respect such quality”, point the ‘popular’, to suggest that, in this case, the owner shall exercise such powers by attending to the well-being of the animal, avoiding the abuse, the abandonment, or the provocation of a cruel death and unnecessary.
This initiative of the PP comes after a proposition, not of law, of Citizens, debated and supported by most of Congress in February of this year, and that opened the debate on this matter. Training orange was also backed by 243.000 signatures through the digital platform change.org that made getting to the Lower Chamber.
